Terms of Use

By registering for an account, browsing Listings, submitting an inquiry, or otherwise using any part of the Platform, you confirm that you have read, understood and agree to these Terms in full. If you do not agree, you must not use the Platform. We may update these Terms from time to time under section 18; your continued use after an update takes effect constitutes acceptance of the revised Terms.

You must be at least 18 years old and capable of forming a binding contract under the laws of Kenya to create an account. If you register on behalf of a company, agency or other organisation (for example, an Agent/Broker or Developer/Investor account), you confirm that you have the authority to bind that organisation to these Terms, and "you" in these Terms refers to that organisation as well as you personally.

The Platform supports several account types, each with different capabilities: Seekers register with a simple account for searching, saving, messaging and Safe-Meet viewings, and never receive a provider workspace. Landlord/Owner, Agent/Broker and Developer/Investor accounts each create a Workspace — a provider console for managing Listings, bookings, calendar, team members, leads and (on eligible plans) financial reporting. Every account is personal to you; you may not share your login credentials, and you are responsible for all activity that occurs under your account. You must provide accurate registration information and keep it up to date, including a phone number and email address you actually control, since these are used for verification and account-recovery.

GETYOURHOME is a marketplace, trust-verification system and provider software toolkit. We are not a licensed estate agent, valuer, lawyer, or financial adviser, and nothing on the Platform constitutes professional advice of any of those kinds — our Instant Valuation tool, for example, is explicitly an indicative estimate computed from comparable active listings, never a professional valuation or an offer. We are not a party to, and assume no liability arising from, any tenancy, sale, service or other agreement formed between users of the Platform. We do not take custody of funds relating to any transaction between users unless a specific feature explicitly identifies a named, licensed escrow partner handling that custody — in the absence of such a named partner, you must never send money to another user through any channel in reliance on the Platform holding or guaranteeing it.

This is a contractual commitment, not marketing language: no Listing, Provider or Agent may pay GETYOURHOME, in any form, to be ranked higher, featured more prominently, or shown to more Seekers than ranking by Trust Score, verification level and freshness alone would produce. There is no subscription tier, invoice, or side arrangement of any kind that purchases placement. If you believe any GETYOURHOME representative has offered you paid placement, that offer is unauthorised, void, and should be reported to us immediately.

The Trust Score displayed on every Listing and provider profile is computed automatically from published, weighted evidence — verification, proof-of-life freshness, reviews, responsiveness, listing quality, completed Safe-Meet viewings and account tenure — with automatic penalties for confirmed fraud, scam reports, duplicate photos and overdue re-verification. No GETYOURHOME employee or contractor may manually edit a Trust Score outside of a documented, audit-logged fraud review. Attempting to solicit, bribe, or otherwise induce any person to manually alter a Trust Score is a material breach of these Terms and will result in immediate account suspension pending investigation.

If you publish a Listing, you represent and warrant that: you have the legal right to list the property (as owner, or with the owner's authorisation, or as their appointed agent); every statement of fact in the Listing — price, size, bedrooms, bathrooms, amenities, location, availability — is accurate to the best of your knowledge and kept up to date; every photograph, video or 360° image is either taken by you or someone you have authorised, of the actual property being listed, and not duplicated from another listing, another property, or sourced from the internet without rights; and the Listing does not violate any law, any third party's intellectual property rights, or any other person's privacy.

We verify Listings through the mechanisms described on our Trust & Verification page, including automated duplicate-photo detection across the Platform. A Listing found to contain duplicated, misappropriated or materially false content will be suppressed, and repeated or serious violations will result in Trust Score penalties or account suspension as set out in section 6 of our Trust & Verification page.

In addition to the Listing-accuracy obligations above, you agree not to, and not to attempt to:

Fraud and scam reports are reviewed by our human trust and safety team, not resolved automatically. A confirmed fraud finding applies an immediate Trust Score penalty and, upon three confirmed reports against the same Workspace, freezes that entire Workspace pending further review — every party under that Workspace, not just the individual Listing, is affected, because trust is a property of the Workspace as a whole. We reserve the right to suspend or terminate any account, at our reasonable discretion, for conduct that violates these Terms, harms other users, or exposes the Platform to legal or security risk, and to remove any content that violates these Terms.

Seeker accounts are free forever: searching, saving, messaging and Safe-Meet viewings never carry a fee, and we will never introduce a fee for these core Seeker functions retroactively without your ability to decline and continue using the free tier they were promised. Provider Workspaces operate on subscription plans (Free, Host, Pro, Agency), each with published listing and team-seat limits set out on our Plans & Features page; upgrading is a deliberate, self-service action, never an automatic charge. Subscription payments are processed via Safaricom M-Pesa; GETYOURHOME never receives or stores your M-Pesa PIN. Fees, once paid, are generally non-refundable except where required by Kenyan consumer-protection law or expressly stated otherwise at the time of purchase. Prices are quoted in Kenya Shillings (KES) unless stated otherwise.

All in-person property viewings arranged through the Platform should go through Safe-Meet: a scheduled viewing with a confirmation code exchanged between Seeker and Provider at the time of the visit. Never pay any fee to view a property, and never agree to a viewing arranged entirely outside the Platform with a party you have not otherwise verified. Report any request for a viewing fee immediately — it is a violation of these Terms regardless of who requests it.

Providers on eligible plans may accept direct bookings (for short-let and similar Listings) through the Platform's booking inbox and calendar. Cancellation terms, deposit requirements and refund policies for a specific booking are set by the Provider for that Listing and must be clearly stated before a Seeker confirms; GETYOURHOME is not a party to the resulting booking contract and is not liable for a Provider's failure to honour it, though a confirmed pattern of such failures is a Trust Score and fraud-review matter under section 8.

The Platform itself — its software, design, trademarks (including the GETYOURHOME name and mark), the Trust Score methodology, and all original content we author (including our Insights articles) — is owned by GETYOURHOME or our licensors and protected by Kenyan and international intellectual property law. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary methodology without our prior written consent.

You retain ownership of the Listing content, photographs, videos and other material you upload. By uploading it, you grant GETYOURHOME a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content solely for the purpose of operating and promoting the Platform (for example, showing your Listing in search results, on the map, and in a similar-listings carousel). This licence ends when you delete the content or your account, subject to the retention timelines in our Privacy Policy for backup and legal-recovery purposes.

The Platform is provided on an "as available" basis. We work hard for fast, reliable service, but we do not guarantee uninterrupted or error-free operation, and features still in build are always labelled honestly as such rather than presented as finished. Our Instant Valuation, True Cost of Living, and AI Scout tools are indicative and computed from available data; they are not professional advice and must not be relied upon as such. To the maximum extent permitted by Kenyan law, GETYOURHOME is not liable for indirect, incidental, or consequential losses arising from your use of the Platform, from any transaction or agreement you enter with another user, or from content another user has published; nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by our negligence.

You agree to indemnify and hold GETYOURHOME harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your Listing content, or your conduct toward another user of the Platform.

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of the Platform that cannot be resolved informally through our Help Center will be subject to the exclusive jurisdiction of the courts of Kenya. We encourage you to contact us first — most concerns are resolved faster that way than through formal proceedings.

You may close your account at any time from My Profile / My Account, which triggers the deletion process described in our Privacy Policy. We may suspend or terminate your account for a material breach of these Terms, following the enforcement process in section 8 where applicable. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) continue to apply after your account is closed.

We may update these Terms as the Platform evolves. Where a change is material, we will give active users reasonable advance notice in-app or by email before it takes effect, and the "Last updated" date above will always reflect the current version. If you do not agree with a material change, your remedy is to close your account before it takes effect; continuing to use the Platform after that point constitutes acceptance.
